Ekspertė paaiškino, kaip rizikuojame perpirkdami bilietus iš kitų asmenų

Apsukrumas ar nuoširdus noras, kam nors parduoti bilietą, kai pats nebegali eiti į koncertą? Praėjusią savaitę per keliolika minučių iššlavus bilietus į Justin Timberlake koncertą, internete atsirado nemažai skelbimų, siūlančius įsigyti bilietus iš privačių asmenų. 

Kaip apsisaugoti nuo tokių sukčių ir ką reikėtų keisti teisiškai, plačiau pakomentavo Valstybinės vartotojų teisių apsaugos tarnybos direktorė Goda Aleksaitė. 

– Ar bilietų perpardavinėjimas yra galimas? 

– Tai – labai vertintinas dalykas. Jeigu fizinis asmuo prisiperka daug bilietų ir perpardavinėja, tai jis gali būti baudžiamas pagal administracinių nusižengimų kodeksą, nes tai yra neteisėta komercinė veikla.

– Kalbant apie koncertus, mes matome paskutinius pavyzdžius, kai perpardavinėtojai siūlo bilietus į J. Timberlake'o koncertą skelbimų portaluose. Ar saugu pirkti bilietą iš tokių skelbimų?

 

– Iš tiesų, saugumo yra mažiau. Kadangi perkate iš fizinio asmens, Vartotojų tarnyba negalės nei padėti, nei konsultuoti, nei priimti privalomų nutarimų, nes tai – dviejų asmenų santykis. Saugumo lygis tokioje situacijoje yra daug mažesnis.

– Jeigu nusipirkote bilietą, o atėjus į renginį, kontrolė sako, kad bilietas jau panaudotas, ką galite daryti ir kas jums padės? Jūs sakot, kad tarnyba negali padėti.  

– Taip, tarnyba negali padėti, nes tai buvo jūsų atsakomybė pasitikrinti, iš ko perkate. Jeigu bilietą pirkote per skelbimų portalus ar socialinius tinklus, deja, turėjote įsitikinti, kad perkate iš patikimo pardavėjo. Kai ateisite, gali būti, kad bilietas bus panaudotas, tada liksite be renginio ir su blogomis emocijomis.

– Ar tokiu atveju galima kreiptis į policiją? Ką daryti?  

– Taip, perpardavinėjimas yra neteisėta veikla, tad tai jau policijos tyrimas. Jei tai bus masiškai vykdoma, tikimės, kad policija imsis veiksmų, nes tai nėra mažareikšmis atvejis.

– Kaip apsaugoti pirkėjus ir išvengti tokių situacijų?  

– Aš tikiu verslo savireguliacija. Verslai jau pradeda naudoti tam tikrus instrumentus, pavyzdžiui, bilietų personalizaciją arba galimybę bilietą perparduoti per specializuotas sistemas. Kitose šalyse yra įstatymai, draudžiantys perpardavinėti bilietus. Pavyzdžiui, Nyderlanduose galima tik grąžinti bilietą pardavėjui, jei persigalvojote arba nenorite dalyvauti renginyje. Lietuvoje galime pasitikėti verslais ir vartotojų sąmoningumu. Jei pirkėjai nustos pirkti bilietus iš perpardavinėtojų, pasiūlos tiesiog nebeliks.

 – Kalbant apie personalizuotus bilietus, neseniai įvyko Edo Sheerano koncertas, kur buvo naudojami personalizuoti bilietai, ir žmonės piktinosi, nes sunku žinoti, su kuo po pusmečio eisi į koncertą. Ar matote poreikį keisti įstatymus ir pradėti pardavinėti personalizuotus bilietus?  

– Štai kas ir atsitiko, buvo personalizuoti bilietai, ten atsirado problemos, ir tada mes paleidžiame be jokių personalizacijų ir saugiklių. Turėtume rasti kažkokį kompromisą. Kalbant iš teisinės vykdytojo pozicijos, mums, be abejo, būtų lengviau, jei visa tai būtų aiškiai sureguliuota įstatymu. Tačiau čia jau įstatymų leidžiamoji valdžia turėtų apie tai pagalvoti per pavasario sesiją – ar norėtų užtikrinti tokią aukštą vartotojų teisių apsaugą?

Cunning or a sincere desire to sell a ticket to someone when you can no longer go to the concert yourself? Last week, after Justin Timberlake's concert tickets were sold out in a matter of minutes, a number of ads appeared online offering to buy tickets from private individuals.

Goda Aleksaitė, director of the State Consumer Rights Protection Service, commented in more detail on how to protect oneself from such fraudsters and what should be changed legally.

- Is ticket resale possible?

- This is a very valuable thing. If a natural person buys a lot of tickets and resells them, he can be punished under the Code of Administrative Offenses, as this is an illegal commercial activity.

- As for concerts, we see the latest examples of resellers offering tickets to Mr. Timberlake's concert on ad portals. Is it safe to buy a ticket from such ads?

- In fact, there is less security. Since you are buying from a natural person, the Consumer Service will not be able to help, advise, or make binding decisions, as this is a relationship between two people. The level of security in such a situation is much lower.

- If you bought a ticket, and when you come to the event, the control says that the ticket has already been used, what can you do and who will help you? You say the service can't help.

- Yes, the service cannot help as it was your responsibility to check who you are buying from. If you bought a ticket through classifieds portals or social networks, unfortunately, you should have made sure that you are buying from a reliable seller. When you come, it is possible that the ticket will be used, then you will be left without an event and with bad emotions.

- In such a case, is it possible to contact the police? What to do?

- Yes, reselling is an illegal activity, so it is already a police investigation. If this is mass-produced, we hope the police will take action, as this is not a trivial case.

- How to protect buyers and avoid such situations?

- I believe in business self-regulation. Businesses are already starting to use certain instruments, such as personalization of tickets or the possibility of reselling the ticket through specialized systems. Other countries have laws against reselling tickets. For example, in the Netherlands, you can only return the ticket to the seller if you change your mind or don't want to attend the event. In Lithuania, we can trust businesses and consumer awareness. If buyers stop buying tickets from resellers, the supply will simply run out.

 - Speaking of personalized tickets, there was an Ed Sheeran concert recently where they used personalized tickets and people were outraged because it's hard to know who you're going to the concert with six months from now. Do you see the need to change the law and start selling personalized tickets?

- That's what happened, there were personalized tickets, there were problems, and then we launch without any personalization and security. We should find some kind of compromise. Speaking from the legal position of the executor, it would certainly be easier for us if all this were clearly regulated by law. But this is where the legislature should think about it during the spring session - would they want to ensure such a high level of consumer protection?
